The short version

Welcome to the site. We are glad to share our enthusiasm for this hobby with you, and our goal is to give you helpful, inspiring information for your projects. But working with biological materials and specialised equipment means you are taking matters into your own hands. By using this site you agree that you are entirely responsible for your own safety, for local compliance, and for the outcome of your projects. We provide the information; you provide the common sense. The binding legal terms you agree to by being here are set out below.

1. Acceptance of terms

By accessing, browsing, or otherwise using MushroomGuide.ca (the "Site"), you agree to be bound by these Terms of Use. If you do not agree to all of these terms, you must not access or use the Site.

2. Age requirement

You must be at least the age of majority in your jurisdiction of residence to use this Site. By using the Site, you represent and warrant that you meet this age requirement. If you do not meet this requirement, you must not access or use the Site.

3. Site purpose, content, and assumption of risk

MushroomGuide.ca provides educational and entertainment content related to mushroom cultivation. You acknowledge and agree to the following strict limitations regarding our content:

No illegal substances. This Site strictly prohibits and does not provide information, instruction, or encouragement regarding the cultivation, acquisition, or use of psilocybin or any other illegal or controlled substances. See ourPsilocybin Policy.
No wild foraging advice. This Site does not provide guidance on identifying or consuming wild mushrooms. Wild mushroom foraging carries a high risk of fatal poisoning. Any information on this Site relates strictly to the deliberate cultivation of legal culinary species — indoor growing, and the inoculation of hardwood logs kept outdoors. The line we hold is cultivated versus wild, not indoors versus outdoors: we never cover gathering a mushroom that grew on its own. See ourForaging Policy.
No medical advice. The information provided on the Site is not intended to be a substitute for professional medical advice, diagnosis, or treatment. See our Disclaimer.
Assumption of risk. Cultivation involves the use of specialised equipment (such as pressure canners and scalpels) and biological materials (such as spores and substrates). You acknowledge that these activities carry inherent risks of property damage, mould contamination, and personal injury. You assume all responsibility and risk for any activities you undertake based on information found on the Site.

MUSHROOMGUIDE.CA, INCLUDING ALL CONTENT, SOFTWARE, FUNCTIONS, MATERIALS, AND INFORMATION MADE AVAILABLE ON OR ACCESSED THROUGH THE SITE, IS PROVIDED ON AN "AS-IS" AND "AS-AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMISSIBLE BY LAW, MUSHROOMGUIDE.CA AND ITS OWNERS MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER FOR THE CONTENT ON THE SITE OR THE MATERIALS, INFORMATION, AND FUNCTIONS MADE ACCESSIBLE. You agree to indemnify, defend, and hold harmless MushroomGuide.ca, its owners, operators, affiliates, contributors, and assigns from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your (or anyone using your account's) violation of these Terms of Use, your use or misuse of the Site and its content, your reliance on any information provided on the Site, or your violation of any rights of any other person or entity. MushroomGuide.ca reserves the right to assume the exclusive defence and control of any matter otherwise subject to indemnification by you, in which event you will cooperate in asserting any available defences.

7. Affiliate disclosure

MushroomGuide.ca may participate in various affiliate marketing programs. This means we may earn commissions on purchases made through our links to retailer sites. 8. Intellectual property

The text, guides, calculators, and code on the Site, and the other original content we create, are the property of MushroomGuide.ca or its content suppliers and are protected by Canadian and international copyright laws. Not every image on the Site is our property, and nothing here should be read as a claim of ownership over images we do not own. You may not reproduce, distribute, or create derivative works from our content without express written permission.

9. Third-party links

The Site may contain links to third-party websites or services that are not owned or controlled by MushroomGuide.ca. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

10. Governing law and exclusive venue

These Terms of Use, and any dispute or claim arising out of or in connection with them or their subject matter, shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice or conflict of law provision or rule. You agree that any legal suit, action, or proceeding arising out of, or related to, these Terms of Use or the Site shall be instituted exclusively in the provincial or federal courts located in the Province of Ontario. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

11. Severability

If any provision of these Terms of Use is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms of Use will continue in full force and effect.

12. Modifications to the terms

We reserve the right to modify or replace these Terms of Use at any time. We will provide notice of such changes by updating the "Last updated" date at the top of this document. Your continued use of the Site following the posting of any changes constitutes acceptance of those changes.
